Terms of Service
Last updated: October 16, 2026
These Terms of Service ("Terms") govern your use of stocksentimenttoday.com and the MoodTicker service (the "Service"), operated by MoodTicker, based in New York, USA ("we", "us"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Not investment advice
All content, including sentiment scores, labels such as "Bullish" or "Bearish", rankings, options-activity data, alerts and API output, is produced automatically, is the same for every user, is not tailored to anyone's financial situation, objectives or risk tolerance, and is offered on a bona fide, general and regularly published basis. We intend to rely on the publisher's exclusion from the definition of "investment adviser" under Section 202(a)(11)(D) of the Investment Advisers Act of 1940, as interpreted in Lowe v. SEC, 472 U.S. 181 (1985). We do not provide personalized recommendations, manage money, or communicate with users about their individual investments. Sentiment describes crowd positioning; it is not a forecast. Past or current sentiment does not indicate future results.
2. Assumption of risk
Trading and investing in securities, options and crypto assets involves substantial risk, including the loss of all money invested; options and crypto assets are especially volatile. You are solely responsible for your investment decisions and should consult a licensed professional before acting. You agree that we are not liable for any trading or investment losses, lost profits or missed opportunities arising from your use of, or reliance on, the Service.
3. Data accuracy, delays and third-party data
The Service is built from third-party and public data that may be delayed (options data reflects the latest session), incomplete, inaccurate, unavailable or changed without notice. Scores are computed by automated formulas that can produce misleading results. We do not guarantee the accuracy, completeness, timeliness or availability of any data, or that the Service will be uninterrupted, secure or error-free. We are not responsible for third-party data or services, and we may change, suspend or discontinue any feature, ticker or data input at any time.
4. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. By using it you represent that you meet these requirements.
5. Acceptable use
You agree not to: (a) scrape, crawl, harvest or bulk-download content or data, except through the documented public JSON API within reasonable rate limits; (b) resell, redistribute, sublicense, republish or commercially exploit content or Pro features without our written permission; (c) share Pro access or circumvent paywalls, rate limits or security; (d) reverse engineer, overload or interfere with the Service; (e) use the Service for unlawful purposes, including market manipulation; or (f) represent our content as personalized advice. We may suspend or terminate access for violations.
6. Intellectual property
The Service, including its software, design, scores and compilations, is owned by us or our licensors and protected by law. We grant you a limited, revocable, non-exclusive, non-transferable license for personal, non-commercial use, subject to these Terms. Short quotations with attribution and a link are permitted.
7. Subscriptions, automatic renewal and cancellation
- Before you are charged we present these renewal terms clearly next to the subscribe button and ask for your affirmative consent. Payment is processed by Stripe, Inc.; we never see or store your full card number.
- We will notify you of any price change or material change to the renewal terms in advance, by email where we have it, and before it takes effect. You may cancel before the change applies.
- If we ever offer a free trial or promotional price, we will disclose how long it lasts, what you will be charged afterwards, and how to cancel before you are charged.
- Refunds are described in our Cancellation & Refund Policy.
- Pro features may change over time. If we materially reduce Pro features, you may cancel and request a prorated refund for the unused period.
8. Disclaimer of warranties
9. Limitation of liability
10. Indemnification
You agree to defend, indemnify and hold harmless MoodTicker from any claims, losses, liabilities and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms or the law, or your investment decisions.
11. Where the law differs
Some states and countries do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the limitations above may not apply to you. Nothing in these Terms limits any rights you have under applicable consumer-protection law that cannot be waived by contract.
12. Governing law and venue
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules, and by the Federal Arbitration Act for Section 13. Subject to Section 13, any action must be brought exclusively in the state or federal courts located in New York County, New York, and you consent to their jurisdiction.
13. Binding individual arbitration and class-action waiver
Informal resolution first. Before filing a claim, you agree to email support@stocksentimenttoday.com with a description of the dispute and to try in good faith to resolve it for 30 days.
Arbitration. Except as stated below, any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules or, if the AAA is unavailable, by JAMS under its applicable consumer rules. The arbitrator may award the same individual relief a court could. Arbitration may take place by video or phone, or in your county of residence. Fee allocation will follow the administrator's consumer rules.
Exceptions. Either party may bring an individual claim in small-claims court, or seek injunctive relief in court for intellectual-property infringement or misuse of the Service.
30-day opt-out. You may opt out of this arbitration agreement by emailing support@stocksentimenttoday.com with the subject "Arbitration Opt-Out", your name and your account email, within 30 days of first accepting these Terms. Opting out will not affect any other part of these Terms.
14. Copyright (DMCA) notices
If you believe content on the Service infringes your copyright, send a notice under 17 U.S.C. § 512(c) to support@stocksentimenttoday.com with the subject "DMCA". Include your signature, identification of the work and the allegedly infringing material (with URL), your contact information, a statement of good-faith belief, and a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act. We may terminate repeat infringers.
15. Changes, termination and general terms
We may update these Terms. We will post the new version with a new "last updated" date and, for material changes, give reasonable notice. Continued use after changes take effect means you accept them. We may suspend or terminate access for breach. Sections 1–3 and 6–15 survive termination. If any provision is found unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions stay in full force (severability). Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and us regarding the Service, and you may not assign them without our consent.
